Privacy

Your personal information is used and stored for the sole purpose of processing your order and having your order delivered to you.

Your electronic order is processed via Shopify Payment or PayPal, a secure and highly reliable electronic service, and your credit card information is never known to us. The Company promises that it will never give or sell your contact information to a third party. Product updates or promotions may occasionally be sent to your email address but let us know if you hate that and we’ll remove you from the mailing list.

On a related note, you should know that Google Analytics Advertising Features have been implemented on our website. This means that if you have a Google account, and you consented to having your data used for analytics and marketing, Google might track some of your information: your demographic information would be anonymous, or for the purpose of advertising to you. You are of course free to opt out of this, and you can do this via your Google settings.

Finally, if you have sent us any photos of yours, posted on our social media sites any content, or tagged us in your social media posts, we assume you give us permission to let other people see your amazing content, but if you change your mind, let us know and we will remove the image.

CUSTOMER TERMS OF SALE AND PURCHASE

Acceptance

By ordering and making payment of a product listed on Yogibo (“a Yogibo product”) at the price stated on the Yogibo website in Singapore, the person making the order (“the Customer”) agrees to the Customer Terms of Sale and Purchase with WEB-SHARK Inc.("the Seller").

The Seller reserves the right to decline to proceed with this agreement by refunding any money paid to the Seller by the Customer.

Indemnity

The Customer shall indemnify the Seller from any damage or personal injury that may arise from the improper use of Yogibo products or parts thereof, including, but not limited to the inhalation or consumption of Yogibo products or parts thereof; or enclosing part or all of a human or animal body with a Yogibo product; or inserting a Yogibo product or part thereof into any part of the body.

The Customer shall also indemnify the Seller from any third-party claim on the Customer as a result of the product purchased by the Customer.

The Customer shall also indemnify the Seller from any damage or personal injury that may arise from accessing any third-party websites that are or were linked from the Yogibo website.

Any complaints regarding these third-party websites should be directed to the third-party. The Customer shall also indemnify the Seller from any damage or emotional duress from a delay in delivery, non-delivery, or use of any product ordered from the Yogibo website.

Limitation of Liability

The Seller’s liability for damages under this agreement shall be limited to the amount paid by the Customer for the product ordered by the Customer under which this agreement applies, and the Seller is not liable for consequential, special, indirect or punitive damages.

The Seller also does not accept liability for any third-party claim, or any liability whatsoever for the product ordered being not available for use, lost profits, loss of business.

Product Variation

Due to colours on-screen appearing differently due to varying monitor settings, fabric and material colours on the website may vary slightly in shade or hue from the actual product, and the Customer accepts a reasonable variation in colour. The Yogibo website engages in the use of graphics, videos and other media, including but not limited to third-party apps or websites, in the pursuit of allowing the Customer the ability to have as much information about the product as is possible. In the use of such media, the Customer should accept a reasonable variation due to differences in lighting, sizing-references, and other varying physical and real-world conditions that may result in a different experience from what is seen on the respective media in a controlled or simulated environment.

Website Errors

In the event that the Yogibo website contains typographical or content errors which result in the product being offered at terms other than what the Seller intended, the Seller shall not be responsible for such errors and reserve the right to enforce Clause 1.

Change in Terms or Product

The Seller may revise the terms of sale, prices, dimensions, designs, colours or any other aspect of the products in the Yogibo website, and/or discontinue any of the products in the Yogibo website, and/or change any aspect of the Yogibo website without notice.

This change may affect items that have been stored in the website’s online cart and changes between what is shipped and what has been described in the Yogibo website are possible.

Any changes may also not be apparent immediately if the browser cache is not refreshed after such change.

The Seller is not responsible for any discrepancy between the perceived terms and/or product information and the updated terms and/or product information where the Customer makes a purchase after the terms and/or product information have been changed.

Severability

If any term in this agreement is held to be unenforceable in law, the enforceability of the remaining terms of this agreement shall not be be in any way affected, unless the severance of such term results in a material change to the agreement, rendering the construction of the remaining terms of the agreement to be unreasonable.

Jurisdiction,Governing Law and Dispute Resolution

This agreement shall be governed by and construed in accordance with Singapore law, and all disputes arising out of this agreement shall be subject to the non-exclusive jurisdiction of the Singapore legal system.

The Parties agree to resolve any disputes amicably as a first resort.
